The trial over the alleged attack hedge fund manager Stuart Sugarman suffered at a New York health club began Tuesday.

Stockbroker Christopher Carter attacked Sugarman during a spinning class, Sugarman alleged. The attack resulted in a herniated disk for Sunrise Financial honcho Sugarman, he said.

At issue is the obnoxious acting-out of Sugarman in the class; behavior Carter said he warned Sugarman to curtail.

"You will hear that Sugarman was boorishâ?¦gave [Carter] the finger," Carter attorney Michael Farkas said. But prosecutor Brigid Harrington countered that obnoxious behavior is not a crime.

Carter, Sugarman has said, unleashed a "spine crushing" beating on Sugarman at an Equinox fitness studio in August. Carter charged into Sugarman, sending the hedge fund manager back-first into a wall.

The stockbroker, 44, had become fed up with Sugarman for cheering himself on during the workout. The hedge fund manager during the class would often exclaim "You go girl!"

Carter alleged he had asked Sugarman to shut up, but Sugarman refused.
